How an Alameda County Case Moves Forward

Cases are filed in the Superior Court of California, County of Alameda, and family matters are heard at the Hayward Hall of Justice, 24405 Amador Street, Hayward, CA 94544. A typical divorce begins with a petition and service, followed by financial disclosures, any requests for temporary orders on custody or support, child custody mediation or recommending counseling when parenting is disputed, and then settlement or trial. California's six month waiting period (Family Code section 2339) runs from service or appearance.

For courtroom departments, mediation, self help centers, local rules, and forms, see our Alameda County Family Court Guide.

Alameda County Family Law FAQ

Can I file for divorce in Alameda County?

Under California Family Code section 2320, a divorce judgment requires that one spouse has lived in California for six months and in the county where the case is filed for three months before filing. If you have not met the Alameda County requirement yet, you can file for legal separation first and, once you meet the residency requirements, amend your petition to request a divorce (Family Code section 2321). We can talk through whether that makes sense for you.

How long does a California divorce take?

Under Family Code section 2339, a divorce cannot become final until at least six months after the respondent is served or appears in the case. Many cases take longer, depending on how quickly the spouses resolve property, support, and parenting issues.
